A Neighborly Dispute Takes Center Stage

A recent legal battle in Girrawheen grabbed headlines as Cilla Carden sought to stop her neighbors from cooking barbecues, smoking, and playing ball in their own backyard. While this may seem like a small issue, it has raised significant debate about personal freedoms and the responsibilities we have towards our neighbors.

Carden voiced her frustrations, stating that the smell of meat cooking next door was unbearable for her. “They’ve put it there so I smell fish, all I can smell is fish. I can’t enjoy my backyard, I can’t go out there,” she expressed. Alongside the smell, the cigarette smoke wafting into her yard and the noise from the children playing basketball added to her distress. As a massage therapist, these disturbances affected both her work and her ability to sleep.

In an attempt to address the issue, one of her neighbors allowed 9News into their backyard to show that they had removed the barbecue and stopped the children’s basketball activities. However, Carden remained unsatisfied and escalated the matter to the State Administrative Tribunal and the Supreme Court.

Carden firmly believes that her neighbors are intentionally causing her distress. “It’s deliberate, that’s what I told the courts, it’s deliberate,” she emphasized. Despite her efforts, both the Supreme Court Judge and the State Administrative Tribunal dismissed her case, and her request for an appeal was denied. Nevertheless, Carden persists in her fight and plans to return to court soon.

While Carden’s case may have been dismissed, it has sparked a broader conversation about the rights of individuals to enjoy their own backyard and the responsibilities of neighbors to be considerate towards one another. This dispute serves as a reminder for all of us to strike a balance between personal freedoms and respecting the rights of others.

Though the legal battle has caused quite a stir, the ultimate resolution is still elusive.
